Privacy Policy

This Privacy Policy ("Privacy Policy") applies to the public Wi-Fi Network at «the Network» managed by Eye-In Media. The Network is also governed by the 'Acceptable Use Agreement'. This Privacy Policy does not apply to any third-party websites, applications, or services, even if these are accessible through our products and services. The linking to a third-party website, service, or application is subject to the terms and conditions and privacy policies of the third-party’s website, service, or application. In this policy, both the words “data” and “information” are used interchangeably.

Privacy Policy

Eye-In Media/Eye-in Wireless ("we" or "The Provider") is committed to protecting the privacy and personal data of our users. This Privacy Policy outlines your rights as a user and our practices regarding the collection, storage, use, and deletion of user data on the Network.

1. Collection and Use of Data

1.1 Collection of Data

When using Eye-In Media websites, applications, software or public Wi-Fi networks, we may collect certain data for operational purposes, network security, and to improve our services. The data collected may include:

• Device information (such as MAC address and IP address).

• Personal information (such as but not limited to: email address, phone number, postal code, birthday, and gender).

• Information submitted through Surveys or other similar collecting methods.

• Social Network data provided during the login. Please note that only data approved by the user on the third-party social media site(s) can be collected through Social Network login

• Technical information (such as device type and operating system).

• Geolocation information (such as establishment where the user is connected to the Wi-Fi network).

1.2 Use of Data

The data collected may be used for the following purposes:

• Providing and improving Wi-Fi network services.

• Providing more relevant content during the login process.

• Monitoring and ensuring network security.

• Analyzing usage trends and patterns to optimize network performance.

• To determine the future direction of the Network

• To develop new services or improve existing services.

• To contact you regarding future services.

We do not collect or store biometric data. Biometric data can be used for login authentication purposes and remains solely on your device. 

1.3 Third Party Providers

Personal information about users may be shared with third parties such as Google, Microsoft, Apple, and Meta for marketing efforts for services offered by Eye-In Media and/or its affiliates, subsidiaries, and third parties. 

If you do not wish to be included in our marketing efforts, please head to the Eye-In Wireless login page https://wifi.eye-in.com. After logging into the platform, click on the Account tab, Select Communications Preferences and uncheck selections to unsubscribe. 

Notwithstanding your wish to be no longer included in our marketing efforts, we still may retain personal information and reserve the right to contact you regarding the use of our websites, applications, software, or public Wi-Fi network. Eye-In Media further reserves the right to conduct statistical analyses through the use of data collected through our websites, applications, software, or public Wi-Fi network, on an anonymous and aggregated basis and reserves the right to provide its analyses based on such anonymous and aggregated data to third parties.

2. Data Storage and Security

2.1 Data Storage

User data collected on the Eye-In Wireless public Wi-Fi network is securely stored on our servers and may be retained indefinitely or for a limited period of time as required by applicable laws and regulations.

2.2 Data Security

We implement security measures to protect user data from unauthorized access, alteration, disclosure, or destruction. 

3. User Rights and Account Deletion

3.1 User Rights

As a user of the Eye-In Wireless public Wi-Fi network, you have the right to:

• Access and review the personal information we hold about you. See section 3.2.

• Request corrections to any inaccurate or incomplete personal data.

• Object to the processing of your personal data for certain purposes.

• Obtain a copy of all your Account-related data outlined in section 3.4.

• Request the deletion of your Account and data, subject to the conditions outlined in section 3.5.

3.2 Access and Modify Your Personal Information

To review and modify your personal information, please head to our Eye-In Wireless login page https://wifi.eye-in.com. After logging into the platform, click on the Profile tab where you will see the personal information stored. Modify the information as you’d like to and click on the Save button to apply the modification.

3.3 Retention of Personal Information

The retention period of personal information varies according to the type of information in question and the purpose for which it is used. We retain personal data for as long as it is required to by law or until it is no longer needed for the purpose for which it was collected. 

3.4 Obtain a copy of your Account-related Data

Please head to the Eye-In Wireless login page https://wifi.eye-in.com. After logging into the platform, click on the Account tab, select Manage Your Account, and then select "Export My Personal Data". We will send you a link by email to confirm this action. Open the verification email and click on Download My Data. You will be brought to a page where you will be able to browse all the data stored related to your account. Press the Download Data button to export it in a portable format.

3.5 Account Deletion

If you wish to request the deletion of your Account, please head to the Eye-In Wireless login page https://wifi.eye-in.com. After logging into the platform, click on the Account tab, select "Manage Your Account", and then select "Delete Account and Data". Enter your email address and we will send you a link by email to confirm this action. Open the verification email and click on "the Delete My Account button". If you delete your account, your associated personal data will be deleted or anonymized. Please note that you will not be able to recover your account if you delete it. And you may no longer be able to use our public Wi-Fi network. To be able to use our services again in the future, you will need to create a new account.

This process may take a few days subject to any legal obligations or legitimate interests that require the retention of certain data.

4. E-Mail Communications

Eye-In Media will not monitor, edit, or deliberately disclose private communications unless: (i) required to do so by law; (ii) you grant us permission; or (iii) in the good faith belief that such action is necessary to: (a) comply with the law; (b) comply with any legal process that is served on Eye-In Media; or(c) protect and defend the image, rights or property of Eye-In Media. However, you acknowledge that: (x) there are security and privacy limitations of the Internet which are beyond the control of Eye-In Media; (y) the security, integrity and privacy of any and all information and data exchanged between you and Eye-In Media through the Network cannot be guaranteed; and (z) any such information and data may be viewed or tampered with in transit by a third party.

5. Cookies

Cookies are small data files containing information to specify unique preferences and to provide personalized content. Cookies collect information such as your browser type, time and length of your visit and any personal information you agree to provide. Most browsers are initially set up to accept cookies but visitors always have the option of disabling cookies and you can reset your browser to refuse all cookies or indicate when a cookie is being sent. However, if you refuse cookies, you may be limited in some areas of the Network.

6. Updates to our Privacy Policy

Eye-In Media may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. We encourage you to review this policy periodically.

Terms and Conditions of Use

You are about to access the Internet through a public Wi-Fi network at (the “Network”) operated by Eye-In Media (Hereinafter the “Provider”). The Network is provided to you by the Provider and pursuant to the terms and conditions set out below.

The use and access to the Network and any related Provider products or services (Hereinafter collectively “the Services”) are governed by this Terms and Conditions of Use Agreement (Hereinafter “Agreement”).

The Provider is not responsible for any third-party websites, applications, or services, even if these are accessible through the Services. The linking to a third-party website, service, or application is subject to the terms and conditions and privacy policies of the third-party’s website, service, or application. 

Please read this Agreement carefully and thoroughly. If you acknowledge and accept the terms and conditions of this Agreement, continue to access the Network as directed. If you do not agree to the terms and conditions of this Agreement, disconnect from the Network immediately.

1. Agreement

This Agreement between the Provider and you (hereinafter “the User” or “you”) sets out the duties and responsibilities associated with providing you access to the Network and Services. You may use the Network and Services only if you agree to the following terms and conditions in this Agreement. You are solely responsible for your access to and use of the Network and Services during your period of use, including any breach of this Agreement by you. For the purposes of this Agreement, “you” means you and every person you authorize to use the Network and Services.

2. Use Subject to Provider’s Policies

You agree to comply with and use the Network and Services in accordance with this Agreement, our privacy policy as well any policies to which you are directed when using the Network or Services, and with all applicable laws. You agree to hold the Provider, its affiliates, employees, and agents harmless from all liabilities and expenses related to any violation of this Agreement by you, or in connection with your use of the Network or Services. 

While using the Network or Services, you may not post, transmit or otherwise distribute information constituting or encouraging conduct that would constitute a criminal offence or give rise to civil liability, or otherwise use the Network or Services in a manner which is contrary to law or to the Provider’s policies or would serve to restrict or inhibit any other user from using or enjoying the Network, Services or the Internet.

3. Performance Levels

You are responsible for ensuring your device compatibility with the Network and Services. Speed is a function of the bottlenecks experienced upon the wider network architecture of the Internet itself. As such, the Provider does not guarantee Network performance (nor throughput speed) levels. You understand that any content that you may access through the Network or Services may be subject to “caching” at the intermediate locations on the internet.

Further, the Provider is not responsible for any lost or misdirected data, messages, or pages because of interruptions or performance issues with the Network or Services. The Provider may at any time, in its sole discretion, impose limits on the Network or Services, suspend or terminate the Network or Services, or prevent certain types of usage.

3.1 Network Outages

The Provider shall conduct maintenance of its Network and Services and perform updates from time to time. This may lead to a temporary suspension of the Network or Services.  

4.0 General Liability 

The Provider shall use commercially reasonable efforts to provide the Network and Services to the Customer, subject to and in accordance with the terms and conditions of this Agreement. Subject to any express provisions otherwise in the Agreement relative to the levels at which the Network or Services will be provided, the Provider does not guarantee or warranty the availability or reliability of the Network or Services.

The Provider shall not be liable for any malware or viruses acquired during Internet browsing or downloads. User agrees to exercise caution and utilize appropriate antivirus software to mitigate risks associated with Internet usage. The Provider is not responsible for any damages that result in damage to tangible property. 

4.1 Superior Force (“Force Majeure”)

Neither the Provider nor its employees, officers, directors or representatives shall be liable for failure to perform or delay in performance due to anything beyond the commercially reasonable control of the Provider including, without limited to the generality of the foregoing, any fire, flood, windstorm, ice or snow storm, natural disaster or other act of God, strike, lockout, slowdown, boycott, picketing or other labour difficulty, the act of any governmental, regulatory or judicial authority, any act or negligence of the User or of a third party affecting the provision of a Service, the failure of any telecommunication service of a third party upon which the Provider is reliant to provide any Service to the User, fuel or energy shortage, unavailability of materials or equipment or delays in transportation (collectively and separately “Force Majeure”. 

5. Acceptable Use

The activities described in this Section 5 below constitute violations of this Agreement and are strictly prohibited. While using the Network, you agree not to conduct, at any time, any of the following activities:

  1. Transmitting unsolicited messages which, in the sole judgment of the Provider, cause significant disruption or elicit complaint from other internet users;
  2. Uploading or downloading, transmitting, posting, publishing, receiving, retrieving, storing or otherwise reproducing, distributing, providing access to, or otherwise making available information, software or other material which is:
  3. confidential or infringes or misappropriates the intellectual property rights of others, including patents, copyrights, trademarks, service marks, trade secrets, or any other proprietary right of any third party without prior authorization from the rights holder(s),
  4. untrue, defamatory, libellous, slanderous, abusive, tortuous, pornographic, obscene, child pornography, hate literature; threatening or encourages bodily harm, destruction of property or harasses another, or
  5. constitutes invasion of privacy, appropriation of personality, or unauthorized linking or framing,
  6. Transmitting, posting, receiving, retrieving, storing or otherwise reproducing, distributing or providing access to any program or information designed to assist users in defeating copy protection, registration and any other anti-theft mechanisms associated with commercial or shareware programs;
  7. Transmitting, posting, receiving, retrieving, storing or otherwise reproducing, distributing or providing access to any program or information designed to assist in the fraudulent use of services;
  8. Sending or transmitting identical or substantially similar unsolicited e-mails;
  9. Promoting or facilitating the transmission of unsolicited e-mail messages;
  10. Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message;
  11. Sending e-mail messages with viruses or other disruptive features or attachments or sending e-mail messages to disrupt or cause difficulties in receiving other e-mail;
  12. Intentionally or unintentionally using the Network in violation of any applicable law or regulation; including, but not limited to, advertising, transmitting, or otherwise making available Ponzi schemes, pyramid schemes, fraudulently charging credit cards, pirating software, or making fraudulent offers to sell or buy products, items, or services;
  13. Posting, transmitting or distributing any information or software containing, or regarding the creation of and sending of internet viruses, worms, Trojan Horses, “cancelbots”, pinging, flooding, mailbombing, or other harmful or disruptive components to the Network;
  14. Attempting a Denial of Service attack either via bot or conducted manually;
  15. Accessing, illegally or without authorization the computers, accounts, equipment or networks of a third party, or attempting to penetrate security measures of this or any other system. This includes any activity that may be used as a precursor to an attempted system penetration, including, but not limited to, port scans, stealth scans, or other information gathering activity;
  16. Attempting to collect, use or disclose personal information about third parties without their consent;
  17. Harassing users or groups in any way;
  18. Impersonating users of the Network or any internet service providers in any way;
  19. Selling, transferring, or renting the Network to customers, clients or other third parties, either directly or indirectly;
  20. Conducting activities that include, but are not limited to:
  21. Causing an internet host to become unable to effectively service requests from other hosts,
  22. Running and/or hosting server applications including but not limited to HTTP, FTP, POP, SMTP, Proxy/SOCKS, NNTP,
  23. Analyzing or penetrating an internet host’s security mechanisms,
  24. Forgoing any part of the TCP/IP packet headers in any way, or ny other activity which the Provider may restrict or prohibit from time to time.

Users found in violation of the Acceptable Uses of the Network may, at the sole discretion of the Provider, be investigated by the Provider, and a user’s activities may result in criminal and civil liability to the user. You acknowledge that in such circumstances the Provider may offer its full cooperation to law enforcement agencies if the Provider’s investigation warrants it, as determined by the Provider in its sole discretion. In addition, if the Provider finds, or has reason to believe, that you are in violation of the Acceptable Uses of the Network, the Provider may, at its option, either

  1. Terminate this Agreement, or
  2. Suspend or terminate your rights to use the Network,

All without prejudice to any other remedy that the Provider may have in respect thereof, whether at law or under this Agreement. The Provider does not assume liability to any of its users or to any other Internet user for the Provider’s failure to enforce the terms of this Agreement.

6. No Liability for Content

The Provider does not control, nor is it in any way liable for, data or content that you access or receive via the Network. Be aware that some content, products or services (“Content”) available with or through the Network may be offensive to you or may not comply with applicable laws. 

You understand that neither the Provider nor any of its affiliates, employees or agents attempt to censor or monitor any such Content. You understand, however, that such Content may be subject to “caching” at intermediate locations on the internet when being accessed through the Network. You assume total responsibility and risk for access to or use of such Content and for use of the internet. The Provider and its affiliates, employees and agents assume no liability whatsoever for any claims or losses arising out of or otherwise relating to access to or use of such Content.

7. Security and Privacy

The Provider will not be responsible for any corrupted files or viruses that affect any user of the Network. It is your responsibility to safeguard your system, through appropriate means (e.g., using commercially available software), from theft, unauthorized use or system corruption. 

Provider's servers will automatically collect MAC addresses and/or IP addresses in order to prevent violations of the Acceptable Uses of this Network. 

Personal information collected, used and disclosed by the Provider is done so in accordance with its Privacy Policy and you specifically acknowledge that you have read the Privacy Policy and you consent to the collection, use and disclosure of your personal information pursuant to such Privacy Policy.

The Provider has no obligation to monitor the Services. However, in order to protect itself, its suppliers and its customers, the Provider and its suppliers reserve the right to electronically or otherwise monitor the Services and to disclose any information obtained thereby which is required by law or court or regulatory order. 

The Provider and its suppliers will not intentionally disclose any private e-mail message unless required by law or court or regulatory order. The Provider and its suppliers will comply with all privacy and data protection laws when monitoring the Services and disclosing information obtained thereby and the User agrees that such laws supersede the provisions of any Service Agreement in the event of any conflict or uncertainty. 

The Provider cannot ensure or guarantee privacy for users of the Network or the personal information that may be collected, used or disclosed by third parties as a result of you using the Network to access or purchase from websites or access content provided by third parties. 

It is therefore recommended that the Network not be used for the transmission of confidential or personal information. Any such use shall be at your sole risk and the Provider, its affiliates, employees and agents shall be relieved from all liability in connection therewith. 

8. User Information

Your messages may be the subject of unauthorized third-party interception and review. An individual with Internet access can cause damage, incur expenses and enter into contractual obligations while on the internet. All such matters are your responsibility. The Provider has and accepts no obligation to monitor your use of the Network, nor edit or censor content transmitted via e-mail, downloading, uploading, posting or otherwise, through the Network, however, you agree that the Provider reserves the right:

  1. To monitor the Network electronically from time to time;
  2. To reject or eliminate in whole or in part any information available or transmitted through the Network that, in the Provider’s sole discretion, is in violation of this Agreement or is otherwise inappropriate or unacceptable; and/or
  3. To disclose any information necessary to satisfy any laws, regulations or other governmental request or as necessary to operate the Network or to protect itself or others.

9. Responsibility for Risk

The Provider will not assume any responsibility for your acts or omissions or those of any individual who uses the Network through your computer system, including without limitation, responsibility for any charges you incur when making purchases or conducting other transactions while using the Network. As between the Provider and you, you are better able to put in place physical and procedural impediments to the inappropriate use of and to supervise your computer system. Protection of your computer system shall be your sole responsibility.

10. No Warranties

The User acknowledges that:

  1. The Network may not be uninterrupted or error-free;
  2. Viruses or other harmful applications may be available through the Network; and
  3. The Provider does not guarantee the security of the Network and that unauthorized third parties may access your computer or files or otherwise monitor your connection.

THE NETWORK AND ANY PRODUCTS OR SERVICES PROVIDED ON OR IN CONNECTION WITH THE NETWORK ARE PROVIDED ON AN "AS IS", "AS AVAILABLE" BASIS WITHOUT WARRANTIES, REPRESENTATIONS OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR NON-INFRINGEMENT, OR IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

ALL WARRANTIES, CONDITIONS, REPRESENTATIONS, INDEMNITIES AND GUARANTEES WITH RESPECT TO THE CONTENT OR NETWORK AND THE OPERATION, CAPACITY, SPEED, FUNCTIONALITY, QUALIFICATIONS, OR CAPABILITIES OF THE SERVICES, GOODS OR PERSONNEL RESOURCES PROVIDED HEREUNDER, WHETHER EXPRESS OR IMPLIED, ARISING BY LAW, CUSTOM, PRIOR ORAL OR WRITTEN STATEMENTS BY THE PROVIDER, OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO ANY WARRANTY OF SATISFACTORY QUALITY, MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE, TITLE AND NONINFRINGEMENT, ARE, TO THE EXTENT PERMITTED BY APPLICABLE LAW, HEREBY EXCLUDED.

11. No Liability to User

Under no circumstances shall the Provider, its affiliates, employees or agents be liable to you or any third party for:

  1. Any direct, indirect, special, or consequential damages, including, without limitation, loss of profits and loss of business opportunities that result in any way from this Agreement, including your use of the Network or access to the internet, or any part thereof, or your reliance on or use of information, services or merchandise provided on or through the Network, or that result from mistakes, omissions, interruptions, deletion or corruption of files, error, defects, delays in preparations, or transmission, or failure of performance; or
  2. Any losses or expenses (including legal fees) arising out of, or in connection with any allegation, claim, suit or other proceeding based upon a contention that the use of the Network by you or a third party infringes the intellectual property rights or contractual rights of any third party.

In addition, the Provider, its affiliates, employees and agents are not liable for:

  1. Any act or omission of a telecommunications carrier whose facilities are used in establishing connections to points which the Provider does not directly serve;
  2. Defamation or copyright infringement arising from material transmitted or received over the Provider’s or its affiliates’ facilities; or
  3. Infringement of patents arising from combining or using customer provided facilities with the Provider’s or its affiliates’ facilities.

12. Indemnity

You agree to indemnify and hold harmless the Provider, its affiliates, employees and agents harmless from and against any and all claims, actions, liabilities, losses, damages, costs, or expenses (including without limitation reasonable legal fees and expert witness fees) arising out of or related to your use of the Network, any materials downloaded or uploaded through the Network, any actions taken by you in connection with your use of the Network, any violation of any third party's rights, any violation of any law or regulation, or any breach of this Agreement. This Section will not be construed to limit or exclude any other claims or remedies that the Provider may assert under this Agreement or by law.

13. Entire Agreement

This Agreement including all documents and the Provider’s policies such as their privacy policy referenced herein constitute the entire Agreement and understanding between the Provider and you pertaining to the subject matter hereof, and supersedes and replaces all prior agreements, understandings and representations, written or oral, regarding such subject matter. The failure of the Provider to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. If any of the provisions contained in this Agreement are determined to be void, invalid or otherwise unenforceable by a court of competent jurisdiction, such determination shall not affect the remaining provisions contained herein. This Agreement shall be governed by and construed in accordance with the laws having application in the Province of Quebec, Canada. The user agrees to attorn to the jurisdiction of the Quebec courts and agree that any procedure or action shall be undertaken in the province of Quebec, judicial district of Montreal.
